These Terms of Service (“Terms”) govern your use of the website and the professional services provided by S.H.A.M.E. Investigation & Protective Services Inc. (“Company,” “we,” “us,” or “our”). By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Licensing and Regulatory Disclosure

S.H.A.M.E. Investigation & Protective Services Inc. is a licensed private investigation entity operating under the laws of the State of California.

* Business Address: 11922 Hawthorne Blvd, Hawthorne, CA 90250.

* Regulatory Authority: Private investigators in California are licensed and regulated by the Bureau of Security and Investigative Services (BSIS) within the Department of Consumer Affairs.

2. Scope of Services & Written Agreement

In accordance with California BPC Section 7524, all investigative services must be preceded by a written and signed client service agreement. This agreement will include:

* A detailed description of the scope of work.

* Approximate start and completion dates.

* A clear indication of whether a written report will be provided and the agreed-upon delivery method.

3. Professional Standards and Conduct

We adhere to the highest professional standards and the CALI Code of Ethics.

* Lawful Purpose: We only undertake assignments for lawful purposes. We will not violate any person’s constitutional rights, including rights to privacy and freedom from harassment.

* Trespassing: Our investigators will not enter private property or businesses without a proper warrant or lawful authorization.

* Cooperation with Law Enforcement: We reserve the right to cooperate with law enforcement and governmental agencies and will not interfere with ongoing official investigations.

4. Fees, Retainers, and Payments

* Fee Breakdown: All fees, including hourly rates, mileage, and administrative costs, will be clearly itemized in your specific Service Agreement.

* Retainers: A non-refundable retainer may be required before work commences.

* Authorization: No charges shall accrue for services outside the original scope without your prior written authorization.

5. Confidentiality and Work Product

* Non-Disclosure: We maintain strict confidentiality regarding all client matters. This duty of confidentiality extends beyond the termination of our agreement.

* Ownership of Records: Unless otherwise agreed, the Company maintains ownership of original investigative materials, though clients are entitled to agreed-upon reports.

* Record Retention: We maintain legible copies of signed agreements and investigative findings for a minimum of two years, as required by California law.

6. Limitation of Liability and Indemnification

* No Guarantees: Due to the nature of investigative work, we do not guarantee specific outcomes or the accuracy of third-party data.

* Indemnification: You agree to indemnify and hold us harmless from any claims, losses, or liabilities arising from information you provide or your use of the investigative findings in an unlawful manner.

* Insurance: As a California LLC, we maintain a minimum of $1,000,000 in general liability insurance as required by BPC Section 7520.3.

7. Termination of Services

Either party may terminate the service agreement with written notice. Upon termination, you are responsible for payment for all services rendered and expenses incurred up to the date of termination.

8. Governing Law and Disputes

These Terms are governed by the laws of the State of California. Any disputes arising from these Terms or our services shall be resolved through mandatory negotiations or in a court of competent jurisdiction within Los Angeles County.
